PRIVACY POLICY

GENERAL PROVISIONS

  1. https://eshop.vtsgroup.com/ does not automatically collect any information, in particular personal data, except for information contained in cookies (Cf. section III of the Privacy Policy).

  1. The Controller of personal data collected through the Online Shop is VTS Plant Spółka z ograniczoną odpowiedzialnością with registered office in Gdańsk, Aleja Grunwaldzka 472 A, 80-309 Gdańsk, eshop@vtsgroup.com – hereinafter referred to as the “Controller”, being at the same time the Service Provider (Seller) of the Online Shop.

  1. Personal data of the Seller and of the Buyer (hereinafter referred to as the Buyer or User) are processed in conformity with the General Data Protection Regulation of 27 April 2016 (Official Journal of the European Union L 119 of 04.05.2016) and with the Act on the Provision of Electronic Services of 18 July 2002 (Dz. U. of 2002, No. 144, item 1204, as amended).

  1. The Controller exercises due diligence in order to protect interests of persons to whom the data refer and, in particular, ensures that the data collected by the Controller are processed in conformity with the law; gathered for specified, lawful purposes and not subjected to further processing inconsistent with these purposes; correct and adequate to purposes, for which they are processed and stored in a form allowing to identify persons to whom they refer for no longer than necessary to achieve the purpose of processing. What is more, the Controller installs cookies also on the User’s terminal equipment and accesses them.

  1. All words, expressions and acronyms used at this website and beginning with a capital letter (e.g. Seller, Online Shop, Buyer) shall be understood in accordance with their definition included in the Rules of the Online Shop available at websites of the Online Shop.

PURPOSE AND SCOPE OF DATA COLLECTION AND DATA RECIPIENTS

  1. Every time the purpose, scope and recipients of data processed by the Controller result from actions undertaken by the Buyer in the Online Shop.

  1. Possible purposes of collection of the Buyer’s personal data by the Controller are as follows:

    1. conclusion and performance of the Sales Contract;

    2. direct marketing of the Controller’s Products.

  1. Possible recipients of personal data of Online Shop’s Buyers:

    1. If a Buyer using the Online Shop chooses delivery by courier, the Controller provides the collected personal data of the Buyer to the selected carrier or intermediary transporting parcels for the Controller.

    2. If a Buyer using the Online Shop chooses electronic payment or card payment, the Controller provides collected personal data of the Buyer to the selected entity servicing the foregoing payments in the Online Shop.

  1. The Controller may process the following personal data of Buyers using the Online Shop: first and last name; e-mail address; contact phone number; delivery address (street, house number, flat number, postal code, town/city; country), address of residence/registered office/business address (if it is different than the delivery address). In the case of Buyers not being consumers, the Controller may additionally process the Customer’s company name and tax identification number (NIP).

  1. Provision of personal data referred to in the point above may be indispensible for the conclusion and performance of the Sales Contract through the Online Shop. The data required for the conclusion of a contract are specified every time at the website of the Online Shop and in the Rules of the Online Shop.

  2. In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna's own privacy notice .

BASIS FOR PERSONAL DATA PROCESSING

  1. Provision of personal data by the Buyer is voluntary, although a failure to provide personal data indicated on the website of the Online Shop and in the Rules of the Online Shop which are indispensible to execute and perform a Sales Contract results in the lack of possibility to conclude such a contract.

  1. The basis for the processing of personal data of the Buyer is the necessity to perform a contract to which the Buyer is a party or to undertake actions, at their request, before the conclusion of the contract, as well as the fulfilment of legally justified objectives pursued by the Controller. In the case of data processing conducted for the purposes of direct marketing of the Controller’s Products, the basis for such a processing is: a prior consent of the Buyer.

RIGHT TO ACCESS THE CONTENT OF ONE’S PERSONAL DATA AND TO RECTIFY THEM

  1. The Buyer has the right to access the content of their personal data and to rectify them.

  1. Everyone is authorised to control the processing of data which refer to them and are contained in the Controller’s set of data, and especially to: request supplementation, update or correction of personal data, temporary or permanent cessation of their processing, their erasure, transfer or filing a complaint to the supervisory authority.

  1. If the Buyer gives their consent to have their data processed for the purposes of direct marketing of the Controller’s Products, the consent may be withdrawn at any time.

  1. If the Controller is planning to process or processes data of the Buyer for the purposes of direct marketing of the Controller’s Products, the person to whom the data refer is also authorised to (a submit a written, motivated request for cessation of processing of their data due to their special situation or (b to object to the processing of their data.

  1. In order to exercise the rights referred to above, one may contact the Controller by sending an appropriate e-mail message to the Controller’s address specified in point I. 2 of this Privacy Policy (eshop@vtsgroup.com).

COOKIES AND OPERATING DATA

  1. Cookies are computer data, in particular text files, that are stored in the https://eshop.vtsgroup.com/ User’s terminal equipment and intended for the use of the following website: https://eshop.vtsgroup.com/. Cookies usually contain the name of the website to which they are related, the time for which they are to be stored in the terminal equipment and a unique number.   1. In the case of https://eshop.vtsgroup.com/, session cookies are used. Session cookies are temporary files stored in the User’s terminal equipment until the User logs out, leaves the website or turns the software (web browser) off. The Controller may process the data contained in Cookies when visitors use the website of the Online Shop for the following purposes:

    1. Identifying Buyers as logged in the Online Shop and showing them, that they are logged-in;

    2. saving Products added to cart in order for the purposes of placing an Order;

    3. storing data from filled Order Forms, surveys or data used to log in to the Online Shop;

    4. adjusting the content of the Online Shop to individual preferences of Buyers (concerning e.g. colours, font size, page layout) and optimising the use of the Online Shop;

    5. keeping anonymous statistics presenting the manner in which the website of the Online Shop is used.

The following types of cookies are used within the framework of https://eshop.vtsgroup.com/: “necessary” cookies that allow to use services available on https://eshop.vtsgroup.com/, e.g. authentication cookies used for services requiring authentication within https://eshop.vtsgroup.com/; “marketing” cookies, allowing to provide Users with advertising content more adjusted to their requirements and interests.

  1. In many cases software used to browse websites (web browser) allows for storing cookies in the User’s terminal equipment by default. Users may at any time change settings referring to cookies. Those settings may be changed in particular in such a manner as to block the automatic handling of cookies in the settings of a web browser or to notify the User each time cookies are stored in their equipment.

Internet browser settings concerning cookies are important from the point of view of the consent for the use of cookies by our Online Shop – such a consent may also be expressed by means of Internet browser settings. In the case of lack of such a consent it is necessary to appropriately change Internet browser settings concerning cookies.

  1. The Controller highlights that Service Providers may have their own privacy policies and policies concerning cookies. We recommend reading them. The Controller processes also anonymised operational data related to the use of the Online Shop (the so-called logs – IP address, domain) to generate statistics which help to administer the Online Shop. These are collective and anonymous data, which means they do not contain features allowing to identify the person visiting the Online Shop. Logs are not disclosed to third persons.

  1. The User may subscribe to a newsletter.

FINAL PROVISIONS

  1. The Online Shop may comprise lings to other websites. The Controller recommends to read privacy policies available on these websites after entering them. This Privacy Policy refers only to this Online Shop.

The Contractor shall be obliged to employ technical and organisational means ensuring the protection of processed data adjusted to threats and categories of protected data, and especially to protect the data against disclosure to unauthorised persons, collection by an unauthorised person, processing which violates applicable provisions of law, as well as against any change, loss, damage or destruction.

  1. The Controller appropriately makes available the following technical means preventing unauthorised persons from accessing and modifying personal data sent by electronic means:

    1. protection of data sets against unauthorised access.

    2. Access to the Account only after the provision of an individual login and password.
